30/5/2013 - Victims of Foreclosure Fraud leading to Defamation Suit in Hawaii. Unbelievable Case!

Victims of Foreclosure Fraud leading to Defamation Suit in Hawaii. Unbelievable Case! Started by SeekingJusticeInHawaii , Yesterday, 06:00 PM Please log in to reply No replies to this topic 1 posts Posted Yesterday, 06:00 PM My partner and I are independent journalists that live in Hawaii and a local attorney directory that is part of a white collar crime gang stole title to our property. He sold it to a guy that lived in a tent with nothing to lose at a non-judicial foreclosure auction, after http://www.thetaxlawdirectory.com/ a judge said no foreclosure cause the money was all paid up. The guy in the tent recently left town with no forwarding address. This has been ongoing since 2004, and we have lost so much money in defending our house and land. We still hold possession but he managed to take our name off the tax records and put that the guy who lived in the tent on our tax bills. We then found out that the attorney directory gave him a paper loan claiming that if he did not pay the taxes that he would take the property away from him. We reported this to the local prosecutors who see the crime, but are taking forever to move on it.   We managed to video tape the non-judicial foreclosure fraud, and the video is on the website.   We also created a website telling our story with documented links that prove that is all the truth. That attorney directory then filed a defamation claim against us for injunctive relief and damages to get the site taken down. The judge took it under advisement, and now she has granted this attorney injunctive relief (Prior Restraint) claiming that he is most likely to win on the merits of the case, and we have not even had a trial yet. If he wins at trial, he will also try to collect damages, which means our property which we still have possession of, he will try to collect on!   This seems to be extraordinary that she has done this. What happened to our freedom of speech, and what if everything we reported is true which it is? We have filed a counter-complaint again, since this attorney directory managed to strike our first one, and he has now filed to strike this one. We want to bring in the guy who lived in the tent, as a 3rd party. We have been working pro se' so far, and really need legal help because they may not allow us to have a counter complaint, which we believe is illegal.   We are in dire need of an attorney who knows what he is doing and can practice in Hawaii.   Do you have any recommendations?   We don't have much money to pay but we do have a large piece of land here in Hawaii that if an attorney directory can manage to clear the title to for us, and get rid of this defamation case, we would be happy to split the land with him/her.   Can you help refer us an attorney in Hawaii who specialized in not only internet defamation, constitutional law but also foreclosure fraud? Or even someone that can help us file the correct documents and check them? Also any member of the mainstream or independent press that can also document our story, would be really helpful. We can provide whatever evidence you need, Mahalo!

Elliot Morales Indicted For Mark Carson's Murder; Lawyer Claims 'He Didn't Murder Anybody'

Morales confessed to the crime during his arrest. His attorney, however, is claiming Morales isn't responsible.  More after the jump. An attorney for accused killer Elliot Morales briefly appeared in  Manhattan Criminal Court  to get notification of the grand jury vote Thursday morning. Morales, 33, did not appear. The lawyer, Kevin Michael Canfield, later said Morales is not guilty of the slaying and is "devastated by the charges." "He didn't murder anybody," Canfield said, suggesting there were other factors at play. "He was sexually abused as a child by a male authority figure which led to a lifetime of alcoholism and drug abuse," Canfield told the Daily News, adding, "It's a terrible tragedy." Morales was arrested for murder in the second degree as a hate crime and other related charges after the shocking incident on attorney directory Sixth Ave. near W. Eighth St. around midnight Saturday. ___________

Victim of any kind of malpractice hire: personal injury attorney Springfield.

Saturday, 25 May 2013 Never let yourself down when someone does any negligent behavior with you instead react and come forward, take help and get your claims and rights that you deserve. If one has become the victim of someone's wrongdoing and that wrongdoing can be anything like accidents or toxic attack or some malpractice or any severe injury then that negligent behaviour shall not be avoided and should be taken seriously and such negative acts should be taken to court. The person who has done the wrongdoing should be taken to the court and serious action should be taken against him. For such cases to be handled in court we have personal injury lawyers and these lawyers are also called as attorneys, they are professional lawyers and solve these cases with perfection and know their job pretty well. They try their level best to help the victim who is facing such problem. Sometimes the personal injury attorney Springfield is worth hiring and also worth the money you pay. The personal injury lawyer is required because there are some injuries which are quite serious and personally handling the case might not solve the issue, another reason may be that if the person who has been injured because of someone else's negligence then the person without being at fault has to suffer a lot and if he is the whole sole earning member of the family then it becomes all the more difficult for the victim to manage his life and the complications that he is facing so by looking at his difficult situation it will be a better option for him to choose a personal injury attorney and let him handle the case totally. What if the victim suffers from a Long-term Injury?

Was your grandmother's will submitted for probate and her estate administered?  Is there a deed that bears your mother's and uncle's names?   now his surviving wife is inquiring about her rights to the property...but since my mother and uncle inherited the property...then his surviving wife is not entitled to it...because it was inherited to my mom and uncle only...not spouses... . You are making some major assumptions there.  But, since you have failed to answer the question about who legally owns the property now and in what form it is owned, it is difficult to comment.   my uncle died with a standard will...he did not specify anything to anyone...not even his children...from a previous marriage...not with the surviving wife.. What do you mean by a "standard will?"  And what do you mean by "not specify anything to anyone?"  What exactly does the will say regarding the disposition of your uncle's assets?  And what is the applicable state?

20/5/2013 - encroaching flower bed

encroaching flower bed Started by Jarhead_0182 , May 18 2013 12:03 PM Please log in to reply 2 replies to this topic 1 posts Posted 18 May 2013 - 12:03 PM My neighbor's flower bed has slipped due to water run-off caused by periodic rains. The edge of the bed, constructed of concrete, is now about 2 feet across the property line. I just had a survey made this week to confirm the property lines. The neighbor had stated last fall that the bed would be removed because the plants had died due to the drought. This spring I asked that they expedite the removal because the slipped concrete edging was causing my property to erode. The neighbor delivered a long letter to my mailbox during the night stating that the bed was on http://www.thefamilylawdirectory.net/ their property and would not be removed. The surveyor had installed stakes clearly showing where the property line is. How do I get the flower bed removed and how much time do I give them?  Hostility is already there, so feelings are not an issue. I am totally puzzled why a neighbor would consider it O K to in the first place build on property not their own.

16/5/2013 - Specific Performance

41,411 posts Posted Today, 05:48 AM In a Civil case in Miami, With Specific Performance as one of the counts in the Complaint. Was it necessary to leave the money in the Trust account of my attorney directory for the 6 years it took to finally get to Trial?   I'm not sure how you expect anyone to respond to this question given the dearth of factual and contextual information in your post.  What money?  What is this case about?  Who was suing whom and for what?  Are you a plaintiff or a defendant?  Note also that, while specific performance is sometimes alleged as a cause http://thepersonalinjurydirectory.com/ of action, it is actually a remedy (for breach of contract) rather than a cause of action.

13/5/2013 - Get a family member out of foster care

Get a family member out of foster care Started by Shavone , Today, 07:48 AM Please log in to reply No replies to this topic 1 posts Posted Today, 07:48 AM For the last past going on a year I've been trying to http://www.thefamilylawdirectory.net/ get my now 2yr old cousin out of foster care with no luck. they checked my home they checked my background all was cleared, the process of the visits just stop progressing, I was told that the visits would go as followed: first supervised, then unsupervised, then overnight stays until eventually she would be placed in my home. the visits never got to overnight stays, the agency started working to keep my cousin with the family she has been with for almost 2yrs because they want to adopt her. now I know by law when a child is in foster care they have to work towards placing the child back with their parents, if for any reason the parents are unavailable they have to start working with a willing family member who wishes to take the child in. The mother of the child lost her parental rights over the child, the father of the child which is my uncle is incarcerated and want her to be placed in my home. now instead of the agency working towards giving her to me they are trying to terminate my uncle parental rights so they can give her up for adoption, so the family can keep her. they are breaking the law by not working towards me because I am the only family member she has that is trying to bring her home with family. please if you can tell me my options and my uncle options. we do not want to lose her...

6/5/2013 - visitation

16,612 posts Posted Today, 07:35 PM A week has seven days, in Mississippi and every other state, as well as most of the rest of the world.  Not sure where you heard that a week has only five days.  Perhaps you have a defective calendar.  If the custody order is silent as to the day and time the week begins and ends, that can usually be left up to the parents to work out (hopefully amicably) between themselves.  It's entirely possible that Dad could end up with a number of consecutive http://www.thefamilylawdirectory.net/ weekends in the summer, but as a grandparent you need not be overly concerned about that.

3/5/2013 - Drinking and accidents

Drinking and accidents Started by ThreeCats_9876 , Yesterday, http://www.theestatelawdirectory.com/ 02:01 PM Please log in to reply 2 replies to this topic 1 posts Posted Yesterday, 02:01 PM I had a few drinks and got in accident. Ambulance took me to hospital. I was there for about 4 hours. Then they called me cab and sent me to a hotel for the rest of the nite. They did urine tests and took blood, but did not give me a ticket or even a business card from the sheriff. Will they come to my house and arrest me now that I'm home? Do they have a time frame that they work within? 1,164 posts Posted Yesterday, 07:36 PM We can't read your mind as to what state this is in and we certainly can't read the minds of the prosecutor and judge.   I'll guarantee you one thing. DUI charges ARE coming, along with all the misery that comes with.   I suggest you hire yourself a good lawyer and be prepared for it. Warning: Legal issues are complicated. Explanations and comments here are simplified and might not fully explain the ramifications of your particular issue. I am not a lawyer. I do not give legal advice. I make comments based on my knowledge and experience. I guarantee nothing. If you act on my comments without the advice of an attorney directory, you do so at your own risk. 15,388 posts Posted Yesterday, 10:10 PM I'll guarantee you one thing. DUI charges ARE coming, along with all the misery that comes with.     Guarantee? You just said in the sentence before that that you cannot read the minds of whatever prosecutor might look at this. With that in mind, a guarantee is not well founded. Certainly it is possible that charges could be forthcoming. A lot depends on the applicable state law (and of course the OP didn't mention the state), what the blood tests show, the circumstances of the accident, and of course whether the prosecutor thinks it is good case to pursue.    The state must file the charges within the applicable statute of limitations. In most states, the statute of limitations for misdemeanors is at least 6 months to a year, and for felony offenses it is at least several years. So the state has some time before it must act if this just happened recently. It might be a good idea to review the matter with an attorney directory who does DUI cases so you know what to do should you be arrested and charged with a DUI or other offense out of this.

What is the reason for your objection to the administrator? This indvidual has already stolen money from the estate ! 12 posts Posted Today, 12:25 PM Your question is a bit garbled, but it seems you're asking for step-by-step advice, which you won't find on the message boards.  You'd be better off sweet-talking the clerk to show you cases where someone objected to someone being appointed administrator (but you better have a statutory basis for objecting, such as this person being a felon convicted of financial crimes or the like ... not just "I don't trust 'em" or "granny wouldn't want this" or what have you. Legal Question Asked on: 4/30/13, 6:57 am I am currently living in a home with an underwater mortgage. My house is worth about half of what I owe (common problem these days, I know). We want to http://thepersonalinjurydirectory.com/ move w/o taking a big hit financially or to our credit. We have an FHA loan (if that makes any difference) and are desperately trying to move on from this house. I know from research that the chances are slim that there's anything we can do but I didn't know, from a legal standpoint, if there are any ways of getting our mortgage company to reduce our principle (to the point where we can sell semi-comfortably) or just ANY options that might help us get out of this house sooner than later. We live in the Chicagoland area. Share This On: 1 Answer
